By accessing or using the posgryd platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

posgryd provides a cloud-based business management platform that includes, but is not limited to, point of sale, order management, inventory control, customer relationship management, services and appointment booking, delivery management, employee management and payroll, finance and accounting, analytics, and multi-branch management tools ("Service").

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You are responsible for managing all users within your organization account and their access levels.

4. Subscription and Payment

Some aspects of the Service are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring basis ("Billing Cycle"), either monthly or annually depending on the plan you select.

  • A valid payment method is required to process the payment for your Subscription.
  • Free trial periods do not require a payment method.
  • You may cancel your Subscription at any time, effective at the end of the current Billing Cycle.
  • Refunds are handled on a case-by-case basis at our discretion.
  • We reserve the right to modify pricing with 30 days notice to existing customers.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of posgryd and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of posgryd.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain all rights to the data you input into the Service. We process your data solely to provide and improve the Service.

  • You are responsible for the accuracy and legality of the data you input.
  • We will not sell your data to third parties.
  • You may export your data at any time.
  • Upon account termination, your data will be retained for 30 days before permanent deletion, unless otherwise required by law.

7. Limitation of Liability

In no event shall posgryd, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service;
  • Unauthorized access, use, or alteration of your transmissions or content.

8. Indemnification

You agree to defend, indemnify, and hold harmless posgryd and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or your violation of these Terms.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or through your account settings. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which posgryd operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration, unless otherwise agreed by both parties.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised terms.
